Plain English first: you can use Wheelbase to make your own art, and what you draw is yours. Stores handle payments and refunds. Don't copy or resell the app or its packs. The legal details are below.
Agreement
These Terms are an agreement between you and JC Goodworks, a sole proprietorship ("we", "us"). They cover the Wheelbase apps for Windows, Android, iPad and the web, plus wheel, tire and body packs and this website (together, the "Service"). By installing or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
Who can use Wheelbase
Anyone can use Wheelbase. You must be 13 or older to create an account (16 where local law requires it). Children can use Kids mode with a parent's or guardian's permission. If you're accepting these Terms for a child, you're responsible for their use.
Your license
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Wheelbase on devices you own or control, as allowed by the store you got it from. You may not:
- copy, modify, reverse-engineer, decompile or redistribute the app, except where the law expressly allows it;
- resell, share or publish pack files (
.wbpack) or built-in packs, unless the pack's own license says you can; - get around feature locks, purchase checks or other technical limits;
- use the Service to break the law or to infringe anyone else's rights.
Your drawings
You own the drawings and projects you make with Wheelbase. You can use them however you like, commercially or not, including drawings that use built-in wheel, tire and body guides. We claim no rights in your work, and since your drawings stay on your device, we don't see them. You are responsible for making sure your drawings don't infringe anyone else's trademarks or copyrights (for example, a real manufacturer's logo).
Purchases and subscriptions
- Paid features, packs and passes are sold through Google Play, the Apple App Store or the Microsoft Store. That store's terms cover payment, billing and refunds, and you request refunds from the store.
- Subscriptions (such as an annual pass) renew automatically at the price shown when you subscribed until you cancel. Cancel at least 24 hours before the renewal date in your store account's subscription settings. Deleting the app or your Wheelbase account does not cancel a subscription.
- Packs you receive through a subscription stay usable while it is active. One-time purchases are yours to keep for the life of the product.
- Prices and features can change. A change never takes away something you already paid for, except where the law or a store requires it.
Accounts
If you create an account, keep your sign-in secure and give accurate information. You can delete your account at any time (how). We may suspend accounts that break these Terms.
Our rights
The Service, including its code, design, built-in packs and this website, belongs to JC Goodworks and is protected by law. Wheel, tire and body designs in Wheelbase are generic and original. Names of other companies or products, where they appear, belong to their owners and are used only to describe compatibility.
Feedback
If you send us ideas or suggestions, we may use them without owing you anything.
Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Please save and back up your work: we are not responsible for drawings lost through device failure, deleting the app or clearing browser storage.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, JC GOODWORKS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST DATA OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some places don't allow these limits, so they may not apply to you. Nothing here limits rights you have as a consumer that can't be waived.
App store terms
If you got Wheelbase from the Apple App Store: these Terms are between you and JC Goodworks only, not Apple. Apple is not responsible for the app or its content. Your license is limited to Apple-branded devices you own or control, as the App Store Usage Rules allow. Apple has no duty to provide maintenance or support. If the app fails a warranty that applies, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation. Apple is not responsible for product claims, consumer-protection or legal-compliance claims, or third-party intellectual-property claims; we are, as these Terms provide. You confirm that you are not in a country under a US government embargo, and that you are not on a US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you got Wheelbase from Google Play or the Microsoft Store, that store's terms also apply. If they conflict with these Terms about the store's role, the store's terms control.
Ending these Terms
You can stop using Wheelbase at any time. If you seriously or repeatedly break these Terms, we may end your license. The sections on your drawings, our rights, the disclaimer, the limitation of liability and governing law continue after that.
Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. Disputes go to the state or federal courts in North Carolina, unless the consumer law where you live gives you the right to bring a claim locally.
Changes
We may update these Terms. We'll change the date at the top and, for material changes, tell you in the app before they take effect. Using the Service after that means you accept the new Terms.
